Terms and Conditions
Eligibility requirements
- Home Protection Plus® (HPP), administered by DTE Gas, is available to owners or tenants of residential dwellings with no more than four units on one heating system, or any residential dwelling with a separate heating system for each unit. Residential dwellings are defined as occupied single-family homes, condominiums, townhouses, mobile homes, and manufactured housing.
- Home Protection Plus package pricing is based on single-unit coverage. Homes with a hot water boiler must include the add-on boiler option. Homes with more than one furnace, central air conditioning, or water heater must purchase coverage for each additional appliance. Purchase of additional coverage for multiple kitchen orlaundry appliances is available from Home Protection Plus and is recommended to avert any misunderstandings when services are required.
- All appliances and systems covered by this Contract must meet applicable Code requirements, be reasonably clean and safely accessible, and in good operating condition at the time coverage begins. All appliances must have the model and serial tags to be eligible for service or any other program benefits. DTE Gas reserves the right to perform an on-site inspection of the appliances and systems.
- Home Protection Plus pricing is subject to change at any time. Some Home Protection Plus promotions and service offers may be available for new enrollments only, and/or may be available only in select service areas. Any promotion or service may be subject to change or termination at the sole discretion of DTE Gas.
- Home Protection Plus eligibility requirements, coverage and available services may vary and may change from time to time. Current Coverage is available at hppservices.com.
- These services are not regulated by the Michigan Public Service Commission.
Plan coverage
- Depending on the coverage selected, Home Protection Plus will cover specific (as outlined) repairs to the following appliances and systems: furnace or boiler*; water heater; range/oven/cooktop; refrigerator; clothes washer; clothes dryer; central air conditioning; vented space heater; vented gas fireplace logs; microwave oven; freezer; and dishwasher. Home Protection Plus is not an appliance replacement program.
- Coverage is subject to the limitations and conditions as specified in the Contract Information Booklet (“Contract”) applicable on the Effective Date or the Anniversary Date as defined herein, whichever is later, which DTE Gas may modify from time to time by notice to the customer. After receipt of the Contract Information Booklet, you will have thirty (30) days to terminate subject to paragraph 5 under Plan Coverage. Please read the terms and conditions carefully. Terms of coverage defined:

- Effective Date is the date DTE Gas enrolls the customer in the selected plan.
- Anniversary Date is annual recurrence of the Effective Date.
- Service can begin fifteen (15) days after the Effective Date. Contract Year is the period beginning with the Effective Date and will continue for one year (365 days).
- Home Protection Plus coverage is for a Contract Year.
- Service is having received a Home Protection Plus covered repair as outlined in this document, or a diagnostic assessment of an appliance or system.

Term/termination
- The term of your coverage will begin fifteen (15) days after your “Effective Date” and will continue for one year (Contract Year).
- To ensure that the residence is continually covered, your coverage will automatically renew for additional one-year periods unless you cancel by providing DTE Gas with 30 days’ notice prior to the end of the Contract Year or until otherwise terminated as set forth below.
- Your coverage will remain in effect only by keeping your payments up to date. This includes payments for any other services or goods owed to DTE Gas and/or its affiliates including DTE Electric. Payments made to any DTE affiliated utility entity will first be applied to your utility service accounts of DTE Gas and/or DTE Electric, if applicable, before payments are applied to HPP. If you are delinquent in these payments, service under this program will be denied and/or the Contract terminated at DTE Gas’ discretion without notice.
- If you have received service and wish to terminate your coverage within the Contract Year, you will be responsible for the remaining installments of the Contract Year. If you have not had service, you may request termination at any time. You may request termination by contacting Home Protection Plus at 800.556.0011.
- Termination will become effective after DTE Gas has processed your request to terminate coverage.
- DTE Gas provides a call center that is available to accept, record, and schedule service requests 24 hours a day, 365 days a year. DTE Gas reserves the right to prioritize and schedule all service requests at its discretion as permitted by workload, weather conditions, strikes or any other circumstances beyond our control.

To request service, call 800.556.0011. Upon request, appointments will be arranged for either Home Protection Plus service personnel or an authorized service contractor to provide covered services in accordance with the terms and conditions as described herein and as long as the covered appliances and systems:
- Are located within the confines of the main foundation of the home;
- Become inoperative due to normal wear and tear;
- Are in good working order on the Enrollment Date;
- Are properly installed and appropriately maintained throughout the term of the Home Protection Plus Contract; and
- The request for service is received during the Contract Year.
- For customers enrolled on the Core Deductible Plan, a $75 deductible will be collected by credit card at the time that the request for service call is placed. The deductible is applicable to all service requests placed during the same call.

You are entitled to up to twelve (12) service calls per calendar year beginning on the Effective Date, if applicable, and up to twenty (20) service calls in twenty-four (24 months) measured by calendar years, beginning on the calendar year in which the Effective Date falls, if applicable.
- All service calls in excess of these limits will be imposed a $150 fee per service call until a new calendar year is reached.
- Fees pursuant to this section are owed at the time the service call is placed and cannot be cancelled once a technician has arrived at the covered location.

DTE Gas will not perform repairs on a covered appliance or system under any of the following circumstances:
- When the appliance or system cannot be repaired.
- When the needed repair is listed under Special Circumstances or Items Not Covered.
- When the covered part required to complete a covered repair is no longer available from DTE Gas or authorized service contractor suppliers.
- When DTE Gas or an authorized service contractor determines that the estimated cost of a repair exceeds the current market value of the appliance (current market value will be established through use of the Home Protection Plus Depreciation Guide). DTE Gas will recommend replacement of the appliance at the customer’s expense. No future service on the appliance will be provided under the plan subsequent to this diagnosis. The customer must carry the GreenBacksSM Cash Option to be eligible for any form of financial assistance to replace an appliance.
- Home Protection Plus will not be responsible for charges for service or repairs that others provide without our prior knowledge and approval.
- This Contract does not cover any labor, materials or parts required as a result of flooding, attempted repairs by persons other than DTE Gas personnel or an authorized contractor, abuse, vandalism, electric power outage or surge, water supply failure, accidents, fire, freezing, pet or pest damage, acts of God, tampering or unauthorized alteration or any other abnormal conditions. Installation errors or omissions that result in either equipment failure or performance issues are not covered by this Contract. Service will not be performed in areas where asbestos or any other safety or health hazard exists until the hazard has been eliminated by the customer and at the customer’s sole expense. DTE Gas reserves the right to restrict specific makes of equipment from eligibility due to obsolete parts and reserves the right to use other than original manufacturer’s parts.
- The choice of parts to be used is at DTE Gas’ or their authorized service contractor’s sole discretion. Parts purchased by persons other than an authorized service contractor will not be installed without prior approval.
- The customer will be responsible for costs incurred in missed service appointments.
- DTE Gas may cancel this Contract at any time, with or without cause.
- This Contract constitutes the entire understanding between the parties with respect to the subject matter of this Contract and supersedes any prior discussions, negotiations, agreements, writings and understandings.
Limitation of liability and exclusion of warranties
- In the event of any defects in parts, materials or service provided hereunder, DTE Gas’ only responsibility and the customer’s sole remedy shall be that on request of the customer, during the term of this Contract, DTE Gas will repair or replace the defective part, material or service in accordance with the provisions of this Contract.
- Home Protection Plus does not include coverage for appliances or systems used at commercial properties or residences used as businesses, including but not limited to day care centers, fraternity/sorority houses, adult care and/or nursing homes. Plan coverage is limited to residential-grade appliances and systems, and those items that were manufactured and marketed solely for installation and usage in a residential family building. Coverage includes only those items stated as covered (see What is Covered section for specific details).
- Home Protection Plus plans are service agreements, and not insurance policies.
- DTE Gas and its authorized service contractors will not be liable for direct damage, consequential damages, indirect losses or injuries caused by defects in parts, materials or service provided hereunder, delays, failure to service, unavailability of parts or labor, and any condition beyond reasonable control. Examples of such damages include but are not limited to loss of income, additional living expenses, personal and or property damage, food spoilage.
- DTE Gas will not be responsible for the diagnosis, repair, removal or remediation of mold, mildew, bio-organic growth, rot or fungus, or any damages resulting from or related to mold, mildew, rot or fungus, even when caused by or related to the malfunction, repair, or replacement of a covered system or component.
- DTE Gas shall not be liable to the customer for failure to perform obligations under this Contract due to any acts of God, strikes, lockouts, acts of the public enemy, lightning, fires, storms, floods, explosions, breakage or accident to machinery, the malfunction of any computer systems (hardware or software) or equipment containing embedded systems of DTE Gas or any provider upon which DTE Gas relies, the binding order of any court or governmental authority, or any other cause outside the reasonable control of DTE Gas.
- DTE Gas will not be responsible for any repair or replacement that would violate any local, state, and/or federal law, rule code or regulation. DTE Gas will authorize completion of the repair or replacement upon correction and remedy of the violation and/or potential violation by the customer. Any cost associated with the correction or remedy of such violation is the sole responsibility of the customer.
- DTE Gas reserves the right to assign its rights and obligations to another party.
- DTE GAS HEREBY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PURPOSE.
- If required by law, DTE Gas will provide a broader limited warranty and limitation of liability.

Special circumstances

DTE Gas will not perform repairs under the following conditions:
- For the repair of conditions that preexist the effective of the customers enrollment in the selected plan.
- Service requests not associated with failure of covered appliances.
- Seasonal startup/shutdown inspections (excluding the HPP Safety Check Add-On option***).
- Parts and service not covered under the Contract. Additional charges to the customer may result for parts and labor associated with the above situations. The additional charges will be determined using a DTE Gas or authorized service contractor’s current rates for labor and parts.

Should a circumstance such as availability of parts or replacements, essential non-covered work, or specific customer brand/model preference/requirement necessitate that a covered repair or replacement will not be completed by an authorized service contractor; then reimbursement to the customer will only be considered if:
- The repair/service is a “covered repair/replacement” as outlined in the “What is Covered” section; and
- The customer has provided a copy of a paid-in-full work order/invoice to Home Protection Plus for review.
* Plan coverage provides for a “Standard” thermostat. In the event that you currently have a programmable thermostat, coverage will provide a basic programmable thermostat (excludes Wi-Fi capabilities).
** Sealed system failures are not covered by Home Protection Plus. “Limited Leak Repair” is defined as leaks that do not require pump down and/or recovery (not opening the system). “Major Leak Repair” is defined as leaks that require pump down and/or recovery (opening the system) and are subject to additional repair charges. It is DTE Gas’ sole discretion to determine refrigerant recharging to extend life of AC unit.
*** The HPP Safety Check Add-On Option is available at enrollment and upon plan renewal and entitles the customer to an annual safety inspection for the furnace/boiler.
Note:
If the repair is a covered component but the repair cost exceeds $1,000, it is at DTE Gas’ discretion to deny the repair.
Examples of items not covered - not all inclusive
Heat exchangers; cracked/ruptured boiler (steam or hot water); “tankless” or instantaneous water heaters; appliance cabinetry; window air conditioners; mini split A/C unit; any unit not connected to duct system; ruptured hot water tanks; water heater flushing; compressors or sealed system repair/replacement (for central A/C units, refrigerators and freezers); evaporators, evaporator pans and line sets; all transmission repairs for clothes washers and dishwashers; clothes dryer steam function; appliances used in commercial applications. Commercial heating appliances located in residential dwellings are covered (allowing for the restrictions of this Contract). Other commercial-grade appliances in residential dwellings are not covered. Rooftop installations of heating/cooling units and other appliances; range hoods, sealed cooktops, glass in oven doors, glass in cooktops, glass in microwave oven doors; electric baseboard heating systems; antifreeze (boiler heating systems); heat transfer systems including Amana (HTM), Glo-Core and Lennox (complete heat models); combination boiler-water heater systems (examples include but not limited to: Viessmann, Hydropulse Boilers, and Boiler Mate). Forced air zoning/dampers/controllers. Wall-mounted hot water boiler, condensing boiler, and all high efficiency modulating multi stage condensing boiler (examples include but not limited to: Rinnai and Triangle Tube). Heat pumps, solar and geothermal heating systems; alterations to existing gas piping; carbon monoxide (CO) alarm calls; CO detector inspection/repair; seasonal turn-on/turnoff; remote controls; parts considered as accessory items, including but not limited to: humidifiers, etc., water dispensers, and water lines; modifications/conversions to appliances; manufacturer recalls; cleaning, filter replacement and any maintenance-related repairs; removal, replacement/reconstruction or cleaning of walls, floors, carpeting, tile or surrounding areas; automatic water feeds (steam boilers). Any appliance audio and video components. Flushing or replacement of steam piping. Kegerators are not covered. Induction cooktops are not covered. Appliance replacements are not covered.
GreenbacksSM Cash Allowance Option
The GreenBacks Cash Option can be selected and purchased as an additional plan benefit. You must be enrolled in the Home Protection Plus plan to be eligible to select the GreenBacks Cash Option.

The GreenBacks Cash Option may provide an allowance for each appliance covered under your Home Protection Plus plan when DTE Gas (or an authorized service contractor) declines repairs for the following reasons:
- When the appliance cannot be repaired.
- When the needed repair is listed under Special Circumstances or Additional Items Not Covered or HPP discretion.
- When the covered part required to complete a covered repair is no longer available from approved parts suppliers to DTE Gas or an authorized service contractor.
- When DTE Gas (or an authorized service contractor) determines that the estimated cost of a repair exceeds the current market value of the appliance (current market value will be established through use of the Home Protection Plus Depreciation Guide).
No future service on the appliance will be provided under the plan subsequent to this diagnosis. An allowance (Schedule of Benefits below) may be issued to help offset the cost of purchasing a new appliance.
- Customers must be currently enrolled in Home Protection Plus and GreenBacks Cash Option for a minimum of thirty (30) days prior to the service call to file a GreenBacks claim and be eligible for reimbursement. If there are any arrears on the customer’s Home Protection Plus plan, the arrears will be deducted from the amount of the GreenBacks Cash payment.
- Eligibility for the GreenBacks Cash benefit requires that the needed repairs not be related to manufacturer recalls, installation defects, or any pre-existing conditions. All appliances being replaced must have a model and serial number tag to be eligible for this allowance.
- An appliance will be ineligible for a GreenBacks Cash Option whenever the required repair is deemed to have been the result of flooding, abuse, vandalism, electric power outage or surge, water supply failure, accidents, fire, freezing, pet or pest damage, acts of God, tampering, unauthorized alteration, attempted repairs by persons other than DTE Gas personnel (or an authorized service provider), and/or any other abnormal conditions.
- To initiate a GreenBacks Cash claim, the enrolled customer must contact the Home Protection Plus customer call center at 800.556.0011 and advise that DTE Gas service personnel (or an authorized service contractor) have declined to complete repairs based on a finding listed as above in item #1. The Home Protection Plus representative will notify Home Protection Plus Program Management in order to initiate the processing of a GreenBacks Cash benefit.
- The GreenBacks Cash Option is limited to the amounts set forth in the GreenBacks Cash Option Schedule of Benefits (see below) regardless of the cost to replace the appliance. Once a GreenBacks Cash Benefit has been paid on a covered appliance, the customer must confirm that the covered appliance has been replaced before further service/coverage is provided. Only one cash benefit for the same appliance type will be paid in a 12-month period. Under no circumstances will a Greenbacks Cash Option be provided more than once for the same appliance.
- Customers are required to maintain enrollment in Home Protection Plus and GreenBacks Cash Option for a minimum of one (1) year. If the Home Protection Plus or GreenBacks Cash Option is terminated prior to the expiration of the Contract Year, for any reason, the customer will pay the Company either the balance of the GreenBacks Cash Option amounts owed for the respective Contract Year, or the amount paid by the Company for any GreenBacks Cash benefit paid during the Contract Year, whichever is less.
- A GreenBacks Cash Option Benefit will apply to only those covered appliances, as based on the Home Protection Plus service package selected by the customer at the time of enrollment or renewal in the program.
- GreenBacks Cash Allowance payments are limited to $2,500 per calendar year.

Water Heater Replacement Option Terms & Conditions
Please read and save this information about the Home Protection Plus Water Heater Repair and Replacement Program. For service requests, contract questions, or any other program information, please call 800.556.0011 or visit hppservices.com.
The Water Heater Repair and Replacement Program (“Program”) covers the repair or replacement of a standard electric or gas water heater due to normal wear and tear. Coverage is available for single-family residential dwellings, condominiums or mobile homes (“Home”). This Program is considered a Home Protection Plus plan. Participants must subscribe to the Home Protection Plus Appliance Protection Plan to be eligible for this Program. These Terms and Conditions are to be read in addition to and alongside the “Home Protection Plus Appliance Terms and Conditions.” All “Home Protection Plus Appliance Terms and Conditions” apply to this Program, including the “Limitation of Liability and Exclusion of Warranties” section.
All equipment covered by this contract must meet any and all applicable code requirements, be reasonably clean and safely accessible, and in good operating condition at the time coverage begins. All appliances must have the model and serial tags to be eligible for service, replacement, or any other Program benefits.
- Property enrolled in Home Protection Plus Program must be located within the DTE Energy utility service area and must have an active DTE utility service agreement in order to participate in the Program.
- The Program is offered through DTE Gas, One Energy Plaza Drive, Detroit, MI 48226 (“DTE”)
- Coverage under the Program begins 90 days after enrollment in the Program. Coverage continues thereafter so long as the customer makes timely payments. Monthly coverage payments must be made in advance. The listed monthly Program charge is for one water heater. Additional water heaters may be covered under the Program for an additional per water heater fee equal to the monthly Program price. Coverage is suspended in cases of nonpayment. The customer’s account must be current and in good standing to receive repair and replacement services under the Program.
- The Program covers only the repair or replacement of standard water heaters by DTE. The Program does not cover: (a) any water loss or water damage due to leaking or bursting tanks; (b) the replacement of galvanized piping; (c) installation of chimney liners; or (d) the correction of plumbing and/or electrical installations not meeting applicable building codes. Coverage for the Program is limited to the repair or replacement of Standard Units. Standard Units are 40-50 gallon electric or 40-50 gallon gas home water heaters (“Standard Units”). Standard Units also include power vent/direct vent water heaters, 30-50 gallon – 110V or 220V Single Element (electric), 30-50 gallon – Tall or Low Boy Dual Element (electric), and 30-50 gallon – Mobile Home Type (electric or gas) water heaters. There are additional costs and fees associated with 60 and 75 gallon water heater installations that are not covered by the plan that you will be responsible.
- The following are excluded from coverage under the Program: (a) pre-existing water heater problems; (b) damage to water heaters caused by the willful or negligent action of the customer or a third party, or by other insurable-type cause; (c) damage due to an “Act of God”; (d) removal of obstacles including, but not limited to, walls, crawl space doors, attic doors, heating and air ducts, piping, rotted floors, etc. but will be solely up to the customer for removal in order for the technician to provide service; (e) water heaters considered “nonstandard units”, including, but not limited to: Tabletop, Solar, Tankless, Instant-On, Low Boy Gas, water heaters designed or used for the recirculation of potable water as part of a heating system (e.g. Apollo & MoreFlow), and water heaters with a capacity greater than fifty (50) gallons; (f) any improvements/upgrades/changes required to meet applicable local code; (g) water heaters that have been modified; (h) water heaters that are not up to code; (i) water heaters that are not safely accessible; (j) water heaters that DTE decides, in its sole discretion, are not covered for any other reason.
- Coverage under the Program will remain in effect until terminated by either Program Administrator, or the customer, or upon non-payment by customer, termination of participation in the underlying Home Protection Plus program, or failure to comply with the conditions herein and the Terms and Conditions set out in the Home Protection Plus Appliance Terms and Conditions.
- The DTE Program Administrator shall have the right to modify the Program from time to time and will provide 30 days’ written notice of material changes. The Program Administrator shall also have the right to terminate the Program on 30 days’ written notice. The Program Administrator shall have the right to terminate customer’s ability to participate in the Program at any time.
- DTE reserves the right to contract Program work to designated contractors.
- The customer must designate which water heater(s) is/are covered by the Program when multiple water heaters are present at the time of enrollment. If the customer does not designate the covered water heater, the default water heater shall be deemed to be the water heater serving the main/first floor of the dwelling, or whichever water heater DTE determines to designate as the covered water heater, in DTE’s sole discretion.
- By enrolling in the Program, the customer represents that, to the best of his/her knowledge, the water heater system is free from any pre-existing problems or malfunctions. This includes problems or malfunctions that a reasonable customer would have known about.
- In DTE’s sole and exclusive discretion, DTE’s Program Administrator reserves the right to determine whether repair or replacement is warranted, when service will be provided, what service is necessary and what service will be provided, what tank replacement style is to be installed, and what Tank replacement size is to be utilized. The DTE Program Administrator also reserves the sole and exclusive right to determine coverage eligibility and/or to inspect the water heater to determine coverage eligibility within sixty (60) days from the date of enrollment.
- This is not an insurance policy, it is a Service Contract. Our obligations and the performance to You under this Contract are guaranteed and insured by a policy issued by Wesco Insurance Company, 59 Maiden Lane, 43rd Floor, New York, NY 10038. If a covered claim is not paid within sixty (60) days after proof of loss has been filed, You may file a claim directly with the Insurance Company. Please call (866) 505-4048 for instructions.
- DTE personnel or DTE’s designated contractors must have safe access to the water heater and safe working conditions at and around the work area. DTE disclaims responsibility for payment for work done by anyone other than a Program-approved Program contractor. To be eligible for coverage for a claim under the Program, the customer is required to notify the Program Administrator of the claim condition before any remedial work is attempted on the water heater, either by the customer or any third party.
- The Program and DTE’s liability is limited solely to the repair or replacement of the covered water heater. The Program and DTE shall have no liability for any direct, indirect, special, incidental, consequential or other damages. The Program will not be responsible for damage caused by the customer, third parties, natural disasters or other insurable causes.
- Coverage (repair and/or replacement) is limited to a total of $1,500 per year.
- Customer charges for the Program will appear on the customer’s monthly DTE Energy utility bill.
- DTE will not reimburse the customer for work performed by the customer or by a third party. Any such work may invalidate customer's coverage under the Program, as determined by DTE.
- When the customer files any claim under the Program, coverage under the Program will automatically be extended for a period of 18 months from the date of such claim. Notwithstanding anything to the contrary herein, the customer will not be permitted to terminate coverage under the Program during such period.

Plumbing Terms & Conditions
ELIGIBILITY REQUIREMENTS
- Home Protection Plus®, administered by DTE Gas, is available to owners or tenants of residential dwellings. Residential dwellings are defined as occupied single-family homes, condominiums, town houses, mobile homes, including manufactured housing.
- Property enrolled in Home Protection Plus must be located within the DTE Energy utility service area and must have an active utility service agreement in order to participate in the Home Protection Plus Program.
- All fixtures and systems covered by this Contract must meet Code requirements, be reasonably clean and safely accessible, and in good operating condition at the time coverage begins. DTE Gas reserves the right to perform an on-site inspection of the equipment.
- Home Protection Plus pricing is subject to change at any time. Some Home Protection Plus promotions and service offers may be available for new enrollments only, and/or may be available only in select service areas. Any promotion or service may be subject to change or termination at the sole discretion of DTE Gas.
- Home Protection Plus eligibility requirements, coverage and available services may vary and may change from time to time. These terms and conditions may differ from those provided to DTE Energy Non-Utility customers. DTE Energy Non-Utility program services may differ from those outlined herein.
- These services are not regulated by the Michigan Public Service Commission.
PLAN COVERAGE
- Depending on the coverage selected, Home Protection Plus will cover specific (as outlined) repairs to the following plumbing fixtures and systems: drain stoppage, water leaks/water lines, kitchen/bath/shower faucets and valves, toilet mechanisms, garbage disposal and sump pump. Home Protection Plus is not a fixture and system replacement program.

Coverage is subject to the limitations and conditions as specified in the Contract Information Booklet (“Contract”) applicable on the Effective Date or the Anniversary Date, as the case may be, which DTE Gas may modify from time to time by notice to the customer. After receipt of the Contract Information Booklet, you will have thirty (30) days to terminate subject to paragraph 5 under Plan Coverage. Please read the terms and conditions carefully, and then file for ready reference.
Terms of coverage defined:
- Effective Date is the date DTE Gas enrolls the customer in the selected plan.
- Anniversary Date is annual recurrence of the Effective Date.
- Service can begin fifteen (15) days after the Effective Date. Contract Year is the period beginning with the Effective Date and will continue for one year (365 days).
- Home Protection Plus coverage is for a Contract Year.
- Service is having received a Home Protection Plus covered repair as outlined in this document, or a diagnostic assessment of a fixture or system.

Term/Termination
- The term of your coverage will begin fifteen (15) days after your “Effective Date” and will continue for one (1) year (Contract Year).
- To ensure that the residence is continually covered, your coverage will automatically renew for additional one-year periods unless you cancel by providing DTE Gas with 30 days’ notice prior to the end of the Contract Year or until otherwise terminated as set forth below.
- Your coverage will remain in effect only by keeping your payments up to date. This includes payments for any other services or goods owed to DTE Gas and/or its affiliates. If you are delinquent in these payments, service under this program will be denied and/ or the Contract terminated at DTE Gas’ discretion without notice.
- If you have received service and wish to terminate your coverage within the Contract Year, you will be responsible for the remaining installments of the Contract Year. If you have not had service, you may request termination at any time. You may request termination by contacting Home Protection Plus at 800.556.0011.
- Termination will become effective after DTE Gas has processed your request to terminate coverage.
- Home Protection Plus coverage is not transferable to another location. Should you move during a Contract Year, you may terminate subject to paragraph 5 of Plan Coverage and DTE Gas will automatically begin a new 12-month Contract at your new location with the same plan coverage as your prior location, provided that you begin utility service with DTE Energy within ninety (90) days of termination date from your previous location. A customer may not assign this Contract or any of its rights hereunder.
- If you have prepaid your annual fee in full and DTE Gas cancels the Contract without cause prior to the end of the Contract Year, you may receive a prorated refund of the fee.
- DTE Gas provides a call center that is available to accept, record, and schedule service requests 24 hours a day, 365 days a year. DTE Gas reserves the right to prioritize and schedule all service requests at its discretion as workload, weather conditions, strikes or any other circumstances beyond our control.

To request service, call 800.556.0011. Upon request, appointments will be arranged for an authorized service contractor to provide covered services in accordance with the terms and conditions as described herein and as long as the covered fixtures and systems:
- Are located within the confines of the main foundation of the home.
- Become inoperative due to normal wear and tear.
- Are in good working order on the Enrollment Date.
- Are properly installed and appropriately maintained throughout the term of the Home Protection Plus Contract.
- The request for service is received during the Contract Year.
- For the Plumbing Deductible Plan, a $75 Deductible will be collected by credit card at the time that the service call is placed with the call center for customers enrolled on the Plumbing Deductible Plan. The deductible is applicable to all service requests placed during the same call.

You are entitled to up to twelve (12) service calls per calendar year beginning on the Effective Date, if applicable, and up to twenty (20) service calls in twenty-four (24 months) measured by calendar years, beginning on the calendar year in which the Effective Date falls, if applicable.
- All service calls in excess of these limits will be imposed a $150 fee per service call until a new calendar year is reached.
- Fees pursuant to this section are owed at the time the service call is placed and cannot be cancelled once a technician has arrived at the covered location.DTE Gas will dispatch an authorized service contractor to perform all covered services. The authorized service contractor will be dispatched by Home Protection Plus based on geography and workload availability.

DTE Gas will not perform repairs on a covered fixture or system under any of the following circumstances:
- When the fixture or system cannot be repaired.
- When the needed part (by fixture type) is not listed as What is Covered under Contract Terms.
- When the needed repair is listed under Special Circumstances or Items Not Covered.
- When the covered part required to complete a covered repair is no longer available from DTE Gas or authorized service contractor suppliers.
- Home Protection Plus will not be responsible for charges for service or repairs that others provide without our prior knowledge and consent.
- This Contract does not cover any labor, materials or parts required as a result of flooding, attempted repairs by persons other than DTE Gas personnel or authorized contractor, abuse, vandalism, electric power outage or surge, water supply failure, accidents, fire, freezing, pet or pest damage, acts of God, tampering or unauthorized alteration or any other abnormal conditions. Installation errors or omissions that result in either equipment failure or performance issues are not covered by this Contract. Service will not be performed in areas where asbestos or any other safety or health hazard exists until the hazard has been eliminated by the customer and at the customer’s sole expense. DTE Gas reserves the right to restrict specific makes of equipment from eligibility due to obsolete parts and reserves the right to use other than original manufacturer’s parts.
- The choice of parts to be used is at DTE Gas’ or their authorized service contractor’s sole discretion. Parts purchased by persons other than an authorized service contractor will not be installed without prior approval.
- In the event that plumbing fixture replacement becomes necessary, Builder Standard fixtures will be used (see Builder Standard section).
- The customer will be responsible for costs incurred in missed service appointments.
- DTE Gas may cancel this Contract at any time, with or without cause.
- This Contract constitutes the entire understanding between the parties with respect to the subject matter of this Contract and supersedes any prior discussions, negotiations, agreements, writings and understandings.
LIMITATION OF LIABILITY AND EXCLUSIONS OF WARRANTIES
- In the event of any defects in parts, materials or service provided hereunder, DTE Gas’ only responsibility and the customer’s sole remedy shall be that on request of the customer, during the term of this Contract, DTE Gas will repair or replace the defective part, material or service in accordance with the provisions of this Contract.
- Home Protection Plus does not include coverage for fixtures or systems used at: commercial properties or residences used as businesses, including but not limited to day care centers, fraternity/sorority houses, adult care and/or nursing homes. Plan coverage is limited to residential grade fixtures, systems, and those items that were manufactured and marketed solely for installation and usage in a residential family building. Coverage includes only those items stated as covered (see What is Covered section for specific details).
- Home Protection Plus plans are service agreements, and not insurance policies.
- DTE Gas and its authorized service contractors will not be responsible for direct damage, consequential damages, indirect losses or injuries caused by defects in parts, materials or service provided hereunder, delays, failure to service, unavailability of parts or labor, and any condition beyond reasonable control.
- DTE Gas will not be responsible for the diagnosis, repair, removal or remediation of mold, mildew, bio-organic growth, rot or fungus, or any damages resulting from or related to mold, mildew, rot or fungus, even when caused by or related to the malfunction, repair, or replacement of a covered system or component.
- DTE Gas shall not be liable to the customer for failure to perform obligations under this Contract due to any acts of God, strikes, lockouts, acts of the public enemy, lightning, fires, storms, floods, explosions, breakage or accident to machinery, the malfunction of any computer systems (hardware or software) or equipment containing embedded systems of DTE Gas or any provider upon which DTE Gas relies, the binding order of any court or governmental authority, or any other cause outside the reasonable control of DTE Gas.
- DTE Gas will not be responsible or liable for damages, indirect losses or injuries, loss of income, additional living expenses, personal and/or property damage caused by defects in parts, unavailability of parts, labor, materials or service provided hereunder.
- DTE Gas will not be responsible for any repair or replacement that would violate any local, state, and/or federal law, rule code or regulation. DTE Gas will authorize completion of the repair or replacement upon correction and remedy of the violation and/or potential violation by the customer. Any cost associated with the correction or remedy of such violation is the sole responsibility of the customer.
- The cost of covered services for plumbing protection is limited to $2,000 per Contract Year.
- DTE Gas reserves the right to assign its rights and obligations to another party.
- DTE GAS HEREBY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PURPOSE.
- If required by law, DTE Gas will provide a broader limited warranty and limitation of liability.
PLUMBING COVERAGE
What is covered:
Drain Stoppages: Cleanout of all stopped or clogged drains or vents within the perimeter of the residence’s foundation including bath, kitchen, laundry and toilets.
Water Leaks/Water Lines: Line breaks and leaks in copper piping, pex, polybutylene, or CPVC lines.
Kitchen/Bath/Shower Faucets and Valves: Faucet cartridges, springs, seals, gaskets, shutoff valves, outside spigot, main water valve (after meter if applicable), kitchen faucet, bathroom faucet, bathtub faucet and showerhead.
Toilet/Toilet Mechanisms: Toilet tank flapper with ball cock, handles with lever, valve, wax seal and shutoff valve.
Garbage Disposal: Repair or replacement of garbage disposal. The horsepower of the motor replacement will be same as the original but shall not exceed 3/4 horsepower.
Sump Pump (if selected as additional coverage at enrollment date): All mechanical parts, motor and check valve.
BUILDER STANDARD
- When replacement of fixtures becomes necessary, the authorized service contractors will provide a replacement with “basic” features (referred to as “Builder Standard”) for installation. Builder Standard fixture replacement will offer general features, capacity and efficiency.
- DTE Gas and/or authorized service contractors reserve the right to determine whether covered fixtures will be repaired or replaced. This decision is to be based on availability of replacement components as well as the assessment of the overall condition of the fixture.
- DTE Gas and/or authorized service contractors will not be responsible for matching specific dimensions, color, brands, or any premium fixtures defined as “Upgrades” (see below) of any covered replacement.
FIXTURE UPGRADE
When the customer chooses fixture upgrade, or a specific fixture replacement other than the provided Builder Standard fixture, the customer will be responsible for all additional charges.- Home Protection Plus’ authorized service contractors will calculate the total cost for any requested upgrade for a covered replacement.
- Home Protection Plus’ authorized service contractors will reduce the total cost of the replacement upgrade by the amounts referenced in the upgrade allowance list below.
- The customer will be responsible for payment of the total cost minus the listed upgrade allowance.
- Payment is to be made to the authorized service contractor at (or prior to) fixture installation.

SPECIAL CIRCUMSTANCES

DTE Gas will not perform repairs under the following conditions:
- For the repair of pre-existing conditions.
- Service requests not associated with failure of covered fixtures and systems.
- Parts and service not covered under the Contract. Additional charges to the customer may result for parts and labor associated with the above situations. The additional charges will be determined using a DTE Gas or authorized service contractor’s current rates for labor and parts.

Should a circumstance such as availability of parts or replacements, essential non-covered work, or specific customer brand/model preference/requirement necessitate that a covered repair or replacement will not be completed by an authorized service contractor, then reimbursement to the customer will only be considered if:
- DTE Gas has been informed of the need in advance of repairs, and has authorized the exception.
- The customer has provided a copy of a paid-in-full work order/invoice to Home Protection Plus for review.
- The repair/service is a “covered repair/replacement” as outlined in the “Plumbing Coverage” section.
- The approved reimbursements will not exceed amounts as established in “Fixture Upgrade” section.
ITEMS NOT COVERED
Plumbing: DTE Gas will not be responsible for needed service, repair, or replacement if the needed service remedy is other than a covered service, repair, or replacement as outlined herein. All others are non-covered. For those non-covered situations: (1) DTE Gas will assume only the cost of the diagnostic portion for a non-covered repair. (2) The customer will receive a written estimate from Home Protection Plus’ authorized service contractor for completing the required non-covered service, and has the option to utilize the same authorized service contractor to complete the non-covered repairs. The authorized service contractor will make payment arrangement with the customer at, or prior to, the rendering of a non-covered service. (3) When a customer chooses to obtain a non-covered service from either an authorized service contractor, or an independent source, DTE Gas will not assume responsibility for the cost of those repairs. (4) Essential non-covered repairs, such as code violations or other safety-related situations must be remedied at the expense of the customer before additional covered service can be provided. Additional charges will apply to non-covered repairs, replacements or replacement upgrades. (5) DTE Gas will not assume the responsibility for the cost of service provided by anyone other than the authorized service contractor assigned at DTE Gas’ dispatch unless such service is authorized in advance. (6) Access for repairs or replacement of non-covered items will result in additional charges. (7) Any additional charges will be determined using current rates for labor and parts of Home Protection Plus’ authorized service contractor.

- Abuse of drainage systems (foreign material)
- Lines damaged by freezing or roots (within or outside of the home’s foundation)
- Flow restrictions due to rust, corrosion or chemicals
- Water damage to floors, carpeting, walls, or ceilings
ACCESS/RESTORATION
Covered repairs may require access to plumbing systems through walls, cabinetry, ceilings, or floors.
- DTE Gas and/or authorized service contractors are not liable for restoration or the cost of restoration for any wall coverings, floor or floor coverings, drywall, cabinets, countertops, tiling, grout, paint, wallpaper, or the repair of any cosmetic defects resulting from repair, service, or diagnostic efforts.
- DTE Gas and/or authorized service contractor are not liable for the cost of construction, carpentry, or other modifications made necessary as a result of completing a diagnostic, a covered repair, fixture replacement, or damage to the customer’s property from such actions.
Whole Home Terms & Conditions
Eligibility Requirements
- Home Protection Plus® (HPP), administered by DTE Gas, is available to owners or tenants of residential dwellings with no more than four units on one heating system, or any residential dwelling with a separate heating system for each unit. Residential dwellings are defined as occupied single-family homes, condominiums, townhouses, mobile homes, including manufactured housing.
- Home Protection Plus package pricing is based on single-unit coverage. Homes with a hot water boiler must include the add-on boiler option. Homes with more than one furnace, central air conditioning, or water heater must purchase coverage for each additional appliance. Purchase of additional coverage for multiple kitchen or laundry appliances is available from Home Protection Plus and is recommended to avert any misunderstandings when services are required.
- All appliances, fixtures, and systems covered by this Contract must meet Code requirements, be reasonably clean and safely accessible, and in good operating condition at the time coverage begins. All appliances must have the model and serial tags to be eligible for service or any other program benefits. DTE Gas reserves the right to perform an on-site inspection of the appliances, fixtures, and systems.

- Are properly installed and appropriately maintained throughout the term of the Home Protection Plus Contract; and
- The request for service is received during the Contract Year.
- For the Whole Home Deductible Plan, a $75 Deductible will be collected by credit card at the time that the service call is placed with the call center for customers enrolled on the Whole Home Deductible Plan. The deductible is applicable to all service requests placed during the same call.

You are entitled to up to twelve (12) service calls per calendar year beginning on the Effective Date, if applicable, and up to twenty (20) service calls in twenty-four (24 months) measured by calendar years, beginning on the calendar year in which the Effective Date falls, if applicable.
- All service calls in excess of these limits will be imposed a $150 fee per service call until a new calendar year is reached.
- Fees pursuant to this section are owed at the time the service call is placed and cannot be cancelled once a technician has arrived at the covered location.

DTE Gas will not perform repairs on a covered appliance, fixture, or system under any of the following circumstances:
- When the appliance, fixture or system cannot be repaired.
- When the needed part (by appliance or fixture type) is not listed as What is Covered under Contract Terms.
- When the needed repair is listed under Special Circumstances or Items Not Covered.
- When the covered part required to complete a covered repair is no longer available from DTE Gas or authorized service contractor suppliers.
- When DTE Gas or an authorized service contractor determines that the estimated cost of a repair exceeds the current market value of the appliance (current market value will be established through use of the Home Protection Plus Depreciation Guide). DTE Gas will recommend replacement of the appliance at the customer expense. No future service on the appliance will be provided under the plan subsequent to this diagnosis. The customer must carry the GreenBacksSM Cash Option to be eligible for any form of financial assistance to replace an appliance.
- Home Protection Plus will not be responsible for charges for service or repairs that others provide without our prior knowledge and consent.
- This Contract does not cover any labor, materials or parts required as a result of flooding, attempted repairs by persons other than DTE Gas personnel or an authorized contractor, abuse, vandalism, electric power outage or surge, water supply failure, accidents, fire, freezing, pet or pest damage, acts of God, tampering or unauthorized alteration or any other abnormal conditions. Installation errors or omissions that result in either equipment failure or performance issues are not covered by this Contract. Service will not be performed in areas where asbestos or any other safety or health hazard exists until the hazard has been eliminated by the customer and at the customer’s sole expense. DTE Gas reserves the right to restrict specific makes of equipment from eligibility due to obsolete parts and reserves the right to use other than original manufacturer’s parts.
- The choice of parts to be used is at DTE Gas’ or their authorized service contractor’s sole discretion. Parts purchased by persons other than an authorized service contractor will not be installed without prior approval.
- In the event that plumbing fixture replacement becomes necessary, Builder Standard fixtures will be used (see Builder Standard section).
- The customer will be responsible for costs incurred in missed service appointments.
- DTE Gas may cancel this Contract at any time, with or without cause.
- This Contract constitutes the entire understanding between the parties with respect to the subject matter of this Contract and supersedes any prior discussions, negotiations, agreements, writings and understandings.
Limitation of Liability and Exclusion of Warranties
- In the event of any defects in parts, materials or service provided hereunder, DTE Gas’ only responsibility and the customer’s sole remedy shall be that on request of the customer, during the term of this Contract, DTE Gas will repair or replace the defective part, material or service in accordance with the provisions of this Contract.
- Home Protection Plus does not include coverage for appliances, fixtures or systems used at commercial properties or residences used as businesses, including but not limited to day care centers, fraternity/sorority houses, adult care and/or nursing homes. Plan coverage is limited to residential-grade fixtures, systems, and those items that were manufactured and marketed solely for installation and usage in a residential family building. Coverage includes only those items stated as covered (see What is Covered section for specific details).
- Home Protection Plus plans are service agreements, and not insurance policies.
- DTE Gas and its authorized service contractors will not be responsible for direct damage, consequential damages, indirect losses or injuries caused by defects in parts, materials or service provided hereunder, delays, failure to service, unavailability of parts or labor, and any condition beyond reasonable control.
- DTE Gas will not be responsible for the diagnosis, repair, removal or remediation of mold, mildew, bio-organic growth, rot or fungus, or any damages resulting from or related to mold, mildew, rot or fungus, even when caused by or related to the malfunction, repair, or replacement of a covered system or component.
- DTE Gas shall not be liable to the customer for failure to perform obligations under this Contract due to any acts of God, strikes, lockouts, acts of the public enemy, lightning, fires, storms, floods, explosions, breakage or accident to machinery, the malfunction of any computer systems (hardware or software) or equipment containing embedded systems of DTE Gas or any provider upon which DTE Gas relies, the binding order of any court or governmental authority, or any other cause outside the reasonable control of DTE Gas.
- DTE Gas will not be responsible or liable for damages, indirect losses or injuries, loss of income, additional living expenses, personal and/or property damage caused by defects in parts, unavailability of parts, labor, materials or service provided hereunder.
- DTE Gas will not be responsible for any repair or replacement that would violate any local, state, and/or federal law, rule code or regulation. DTE Gas will authorize completion of the repair or replacement upon correction and remedy of the violation and/or potential violation by the customer. Any cost associated with the correction or remedy of such violation is the sole responsibility of the customer.
- The cost of covered services for plumbing protection is limited to $2,000 per Contract Year.
- DTE Gas reserves the right to assign its rights and obligations to another party.
- DTE GAS HEREBY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PURPOSE.
- If required by law, DTE Gas will provide a broader limited warranty and limitation of liability.

Plumbing Coverage
Drain Stoppages: Cleanout of all stopped or clogged drains or vents within the perimeter of the residence’s foundation including bath, kitchen, laundry and toilets.
Water Leaks/Water Lines: Line breaks and leaks in copper piping, pex, polybutylene, or CPVC lines.
Kitchen/Bath/Shower Faucets and Valves: Faucet cartridges, springs, seals, gaskets, shutoff valves, outside spigot, main water valve (after meter if applicable), kitchen faucet, bathroom faucet, bath tub faucet and shower head.
Toilet/Toilet Mechanisms: Toilet tank flapper with ball cock, handles with lever, valve, wax seal and shutoff valve.
Garbage Disposal: Repair or replacement of garbage disposal. The horsepower of the motor replacement will be same as the original but shall not exceed 3/4 horsepower.
Sump Pump (if selected as additional coverage at enrollment date): All mechanical parts, motor and check valve.
Builder Standard (Refers to Plumbing only)
- When replacement of plumbing fixtures becomes necessary, the authorized service contractors will provide a replacement with “basic” features (referred to as “Builder Standard”) for installation. Builder Standard fixture replacement will offer general features, capacity and efficiency.
- DTE Gas and/or authorized service contractors reserve the right to determine whether covered fixtures will be repaired or replaced. This decision is to be based on availability of replacement components as well as the assessment of the overall condition of the fixture.
- DTE Gas and/or authorized service contractors will not be responsible for matching specific dimensions, color, brands, or any premium fixtures defined as “Upgrades” (see below) of any covered replacement.
Plumbing Fixture Upgrade
When the customer chooses fixture upgrade, or a specific fixture replacement other than the provided Builder Standard fixture, the customer will be responsible for all additional charges.- Home Protection Plus’ authorized service contractors will calculate the total cost for any requested upgrade for a covered replacement.
- Home Protection Plus’ authorized service contractors will reduce the total cost of the replacement upgrade by the amounts referenced in the upgrade allowance list below.
- The customer will be responsible for payment of the total cost minus the listed upgrade allowance.
- Payment is to be made to the authorized service contractor at (or prior to) fixture installation.

Special Circumstances

DTE Gas will not perform repairs under the following conditions:
- For the repair of pre-existing conditions.
- Service requests not associated with failure of covered appliances, fixtures and systems.
- Seasonal startup/shutdown inspections (excluding the Home Protection Plus Safety Check Add-On option***).
- Parts and service not covered under the Contract. Additional charges to the customer may result for parts and labor associated with the above situations. The additional charges will be determined using a DTE Gas or authorized service contractor’s current rates for labor and parts.

Should a circumstance such as availability of parts or replacements, essential non-covered work, or specific customer brand/model preference/requirement necessitate that a covered repair or replacement will not be completed by an authorized service contractor; then reimbursement to the customer will only be considered if:
- The repair/service is a “covered repair/replacement” as outlined in the “What is Covered” section; and
- The customer has provided a copy of a paid-in-full work order/invoice to Home Protection Plus for review; and
- The approved reimbursements will not exceed amounts as established in the “Fixture Upgrade” section.
* Plan coverage provides for a “Standard” thermostat. In the event that you currently have a programmable thermostat, coverage will provide a basic programmable thermostat (excludes Wi-Fi capabilities).
** Sealed system failures are not covered by Home Protection Plus. “Limited Leak Repair” is defined as leaks that do not require pump down and/or recovery (not opening the system). “Major Leak Repair” is defined as leaks that require pump down and/or recovery (opening the system) and are subject to additional repair charges. It is DTE Gas’ sole discretion to determine refrigerant recharging to extend life of AC unit.
***The HPP Safety Check Add-On Option is available at enrollment and upon plan renewal and entitles the customer to an annual safety inspection for the furnace/boiler.
NOTE:
If the repair is a covered component but the repair cost exceeds $1,000, it is at DTE Gas’ discretion to deny the repair.
EXAMPLES OF ITEMS NOT COVERED - NOT ALL INCLUSIVE
Appliances: Heat exchangers; cracked/ruptured boiler (steam or hot water); “tankless” or instantaneous water heaters; appliance cabinetry; window air conditioners; mini split A/C unit; any unit not connected to duct system; ruptured hot water tanks; water heater flushing; compressors or sealed system repair/replacement (for central A/C units, refrigerators and freezers); evaporators, evaporator pans and line sets; all transmission repairs for clothes washers and dishwashers; clothes dryer steam function; appliances used in commercial applications. Commercial heating appliances located in residential dwellings are covered (allowing for the restrictions of this Contract). Other commercial-grade appliances in residential dwellings are not covered. Rooftop installations of heating/cooling units and other appliances; range hoods, sealed cooktops, glass in oven doors, glass in cooktops, glass in microwave oven doors; electric baseboard heating systems; antifreeze (boiler heating systems); heat transfer systems including Amana (HTM), Glo-Core and Lennox (complete heat models); combination boiler-water heater systems (examples include but not limited to: Viessmann, Hydropulse Boilers, and Boiler Mate). Forced air zoning/dampers/controllers. Wall-mounted hot water boiler, condensing boiler, and all high efficiency modulating multi stage condensing boiler (examples include but not limited to: Rinnai and Triangle Tube). Heat pumps, solar and geothermal heating systems; alterations to existing gas piping; carbon monoxide (CO) alarm calls; CO detector inspection/repair; seasonal turn-on/turnoff; remote controls; parts considered as accessory items, including but not limited to: humidifiers, etc., water dispensers, and water lines; modifications/conversions to appliances; manufacturer recalls; cleaning, filter replacement and any maintenance-related repairs; removal, replacement/reconstruction or cleaning of walls, floors, carpeting, tile or surrounding areas; automatic water feeds (steam boilers). Any appliance audio and video components. Flushing or replacement of steam piping. Kegerators are not covered. Induction cooktops are not covered. Appliance replacements are not covered.
Plumbing: DTE Gas will not be responsible for needed service, repair, or replacement if the needed service remedy is other than a covered service, repair, or replacement as outlined herein. All others are non-covered. For those non-covered situations: (1) DTE Gas will assume only the cost of the diagnostic portion for a non-covered repair. (2) The customer will receive a written estimate from Home Protection Plus’ authorized service contractor for completing the required non-covered service, and has the option to utilize the same authorized service contractor to complete the non-covered repairs. The authorized service contractor will make a payment arrangement with the customer at, or prior to, the rendering of a non-covered service. (3) When a customer chooses to obtain a non-covered service from either an authorized service contractor or an independent source, DTE Gas will not assume responsibility for the cost of those repairs. (4) Essential non-covered repairs, such as code violations or other safety-related situations must be remedied at the expense of the customer before additional covered service can be provided. Additional charges will apply to non-covered repairs, replacements or replacement upgrades. (5) DTE Gas will not assume the responsibility for the cost of service provided by anyone other than the authorized service contractor assigned at DTE Gas’ dispatch unless such service is authorized in advance. (6) Access for repairs or replacement of non-covered items will result in additional charges. (7) Any additional charges will be determined using current rates for labor and parts of Home Protection Plus’ authorized service contractor.

Access/Restoration
Covered repairs may require access to plumbing systems through walls, cabinetry, ceilings, or floors.- DTE Gas and/or authorized service contractors are not liable for restoration or the cost of restoration for any wall coverings, floor or floor coverings, drywall, cabinets, countertops, tiling, grout, paint, wallpaper, or the repair of any cosmetic defects resulting from repair, service, or diagnostic efforts.
- DTE Gas and/or an authorized service contractor are not liable for the cost of construction, carpentry, or other modifications made necessary as a result of completing a diagnostic, a covered repair, fixture replacement, or damage to the customer’s property from such actions.
GreenBacksSM Cash Allowance Option (refers to appliance coverage only)
The GreenBacks Cash Option can be selected and purchased as an additional plan benefit. You must be enrolled in the DTE Gas Company’s Home Protection Plus to be eligible to select the GreenBacks Cash Option.

The GreenBacks Cash Option may provide an allowance for each appliance covered under your Home Protection Plus plan when DTE Gas (or an authorized service contractor) declines repairs for the following reasons:
- When the appliance cannot be repaired.
- When the needed repair is listed under Special Circumstances or Additional Items Not Covered or HPP discretion.
- When the covered part required to complete a covered repair is no longer available from approved parts suppliers to DTE Gas or an authorized service contractor.
- When DTE Gas (or an authorized service contractor) determines that the estimated cost of a repair exceeds the current market value of the appliance (current market value will be established through use of the Home Protection Plus Depreciation Guide).
- Customers must be currently enrolled in Home Protection Plus and GreenBacks Cash Option for a minimum of 30 days prior to the service call to file a GreenBacks claim and be eligible for reimbursement. If there are any arrears on the customer’s Home Protection Plus plan, the arrears will be deducted from the amount of the GreenBacks Cash payment.
- Eligibility for the GreenBacks Cash benefit requires that the needed repairs not be related to manufacturer recalls, installation defects, or any pre-existing conditions. All appliances being replaced must have a model and serial number tag to be eligible for this allowance.
- An appliance will be ineligible for a GreenBacks Cash Option whenever the required repair is deemed to have been the result of flooding, abuse, vandalism, electric power outage or surge, water supply failure, accidents, fire, freezing, pet or pest damage, acts of God, tampering, unauthorized alteration, attempted repairs by persons other than DTE Gas personnel (or an authorized service provider), and/or any other abnormal conditions.
- To initiate a GreenBacks Cash claim, the enrolled customer must contact the Home Protection Plus customer call center at 800.556.0011 and advise that DTE Gas service personnel (or an authorized service contractor) have declined to complete repairs based on a finding listed as above in item #1. The Home Protection Plus representative will notify Home Protection Plus Program Management in order to initiate the processing of a GreenBacks Cash benefit.
- The GreenBacks Cash Option is limited to the amounts set forth in the GreenBacks Cash Option Schedule of Benefits (see below) regardless of the cost to replace the appliance. Once a GreenBacks Cash Benefit has been paid on a covered appliance, the customer must confirm that the covered appliance has been replaced before further service/coverage is provided. Only one cash benefit for the same appliance type will be paid in a 12-month period.
- Customers are required to maintain enrollment in Home Protection Plus and GreenBacks Cash Option for a minimum of one (1) year. If the Home Protection Plus or GreenBacks Cash Option is terminated prior to the expiration of the Contract Year, for any reason, the customer will pay either the balance of the GreenBacks Cash Option amounts owed for the respective Contract Year, or the amount paid by the Company for any GreenBacks Cash benefit paid during the Contract Year, whichever is less.
- A GreenBacks Cash Option Benefit will apply to only those covered appliances, as based on the Home Protection Plus service package selected by the customer at the time of enrollment or renewal in the program.
- GreenBacks Cash Allowance payments are limited to $2,500 per calendar year.

SmartGuard Terms & Conditions
- Home Protection Plus®, administered by DTE Gas Co., is available to owners or tenants of residential buildings with no more than three units on one heating system, or any residential dwelling with a separate heating system for each unit. Residential buildings are defined as occupied single-family homes, condominiums, townhouses, mobile homes, and include manufactured housing.
- Property enrolled in Home Protection Plus must be located within DTE Energy’s utility service area and must have an active utility service agreement in order to participate in the Home Protection Plus Program.
- Home Protection Plus is based on single unit coverage. Homes with more than one furnace or central air conditioning unit must purchase coverage for each additional appliance.
- All equipment must meet code requirements and be reasonably clean and safely accessible. All appliances must have the model and serial tags to be eligible for service or any other program benefits. DTE Gas reserves the right to have an on-site inspection of the equipment.
- Home Protection Plus pricing is subject to change at any time. Some Home Protection Plus promotions and service offers may be available for new enrollments only, and/or may be available only in select service areas. Any promotion or service may be subject to change or termination at the sole discretion of DTE Gas. Eligibility requirements, coverage and available services may vary and may change from time to time.
- Home Protection Plus programs are available to qualified DTE Energy customers only. Your plan will remain in effect only by keeping your payments up to date. This includes payments for any other services or goods owed to DTE Gas and/or its affiliates. If you are delinquent in these payments, service under Home Protection Plus will be denied and/or plan will be terminated.
- SmartGuard plans are not appliance repair plans. In the event that repair or replacement of the appliance is recommended, it is solely the homeowner’s responsibility.
- Depending on the plan selected, Home Protection Plus will arrange a one-time yearly maintenance check per appliance to the following equipment: furnace or boiler and central air conditioning unit.
- Home Protection Plus provides a call center that is available to accept, record, and schedule service requests 24 hours a day, 365 days a year. Home Protection Plus reserves the right to prioritize and schedule all service requests at its discretion as workload, weather conditions, strikes or any other circumstances beyond our control permit.
- Service is subject to the limitations and conditions as specified in this Contract Information (“Contract”) applicable on the Effective Date or the Anniversary Date as the case may be, which DTE Gas may modify from time to time by notice to customer. After receipt of this Contract Information, you will have 30 days to terminate. If you have received Service and wish to terminate your coverage within the Contract Year, you will be responsible for the remaining installments of the Contract Year. If you have not had Service, you may request termination at any time by calling 800.556.0011.
- Termination will become effective after DTE Gas has processed your request to terminate coverage.

- Your selected plan will automatically renew for additional one-year periods unless you cancel by providing DTE Energy with 30 days’ notice prior to the end of the Contract Year.
LIMITATION OF LIABILITY
- DTE Gas and its authorized service contractors will not be responsible for direct damage, consequential damages, indirect losses or injuries caused by defects in parts, materials or service provided hereunder, delays, failure to service, unavailability of parts or labor, and any condition beyond reasonable control.
- DTE Gas shall not be liable to the customer for failure to perform obligations under this contract due to any acts of God, strikes, lockouts, acts of the public enemy, lightning, fires, storms, floods, explosions, breakage or accident to machinery, the malfunction of any computer systems (hardware or software) or equipment containing embedded systems of DTE Gas or any provider upon which DTE Gas relies, the binding order of any court or governmental authority, or any other cause outside the reasonable control of DTE Gas.
- DTE Gas reserves the right to assign its rights and obligations to another party.
- DTE GAS HEREBY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PURPOSE.
- If required by law, DTE Gas will provide a broader limited warranty and limitation of liability.

Electric Line Protection Terms & Conditions
Electric Line Protection is offered by DTE Energy to qualified residential customers. As used in this Electric Line Protection agreement (“Agreement”), the terms “we”, “us” and “our” mean DTE Energy. “You” and “your” mean the customer. “Service” means the Electric Line Protection program. “Covered Services” means all the items, specified herein, that are eligible for repair or replacement under the terms of the Electric Line Protection.
Electric Line Coverage
Electric Line Protection is an electrical service plan that provides access to our approved network of independent electrical contractors for installation, repair or, at our option, replacement of certain home electrical components and circuits that wear out or become damaged as a result of normal use. All Service is provided by our network of authorized independent electrical contractors. The Service is available only for single-family residential homes, attached garages that share a common meter with the single-family residential homes, condominiums and manufactured housing with individual electric metering, including renters of these dwellings.
ELIGIBILITY REQUIREMENTS:
- Property enrolled in Home Protection Plus must be located within the DTE Energy utility service area and must have an active utility service agreement in order to participate in the Home Protection Plus Program.
- Home Protection Plus package pricing is based on single unit coverage.
- All equipment covered by this Agreement must meet code requirements, be reasonably clean and safely accessible, and in good operating condition at the time coverage begins. DTE Gas reserves the right to have an on-site inspection of the equipment.
- Home Protection Plus pricing is subject to change at any time. Some Home Protection Plus promotions and service offers may be available for new enrollments only, and/or may be available only in select service areas. Any promotion or service may be subject to change or termination at the sole discretion of DTE Gas.
- Home Protection Plus eligibility requirements, coverage and available services may vary and may change from time to time. These terms and conditions may differ from those provided to DTE Energy Non-Utility customers. DTE Energy Non-Utility program services may differ from those outlined herein.
- These services are not regulated by the Michigan Public Service Commission.
Plan Coverage
- Coverage is subject to the limitations and conditions as specified herein. Please read the terms and conditions carefully.

- The choice of specific parts or fixtures to be used is at the sole discretion of the authorized service provider. DTE Energy and its vendors reserve the right to use other than original manufacturer’s parts.
- In the event that fixture replacement becomes necessary, Builder Standard fixtures will be used (see Builder Standard section).
- Customer will be responsible for costs incurred in missed service appointments.
Covered Services
The following shall constitute the only electrical components (“Components”) covered by this Service with explicit limitations as set forth in this Agreement:
Wall, floor, ceiling and countertop-mounted receptacles (“Electrical Outlets”)
GFCI receptacles/breakers (“Ground Fault Circuit Interrupters”)
AFCI receptacles/breakers (“Arc Fault Circuit Interrupters”)
Wall-mounted switches
Wall-mounted dimmer switches
Light fixtures
Repair or Replacement of Covered Services
In our sole discretion, we have the option to repair or replace any Components. Replacement of Components will be with similar devices. If a Covered Service Component is no longer available or is a special order item, we will provide a reasonable substitute of standard commercial availability and color.
To request service, call 800.556.0011. Upon request, Home Protection Plus will arrange for an authorized service contractor to provide covered services in accordance with the terms and conditions as described herein and as long as the covered:
- Become inoperative due to normal wear and tear.
- Are in good working order on the Enrollment Date.
- Are properly installed and appropriately maintained throughout the term of the Home Protection Plus contract.
- The request for service is received during the Contract Year.
The Service personnel will be dispatched by Home Protection Plus based on geography and workload availability.
Limits of Covered Services
$500 annual limit
Electric Line coverage is limited to $500 annually. We will pay for Covered Services up to $500, materials and labor inclusive, during each calendar year following the first day of Service initiation, provided that the request is made during the term of this Agreement and you have paid for the Service in accordance with this Agreement.
Covered Services limits
Covered Services are limited to your single-phase or three-phase wiring circuits and related electrical components required to deliver electricity throughout your home or attached garage. Condominium common areas are not covered. The Service does not cover repairs or replacements required as a result of misuse, abuse, tampering, theft, vandalism; improper installation by someone other than us; applicable electrical, housing or safety code violations; corrosion, damage from wind, rain, flood, water, ice or any acts of God. The decision that a repair or replacement is not covered for any of these reasons rests solely with us.
Builder Standard
- When replacement of fixtures becomes necessary, The Plan will provide a replacement with “basic” features (referred to as “Builder Standard”) for installation by the authorized service provider. Builder Standard fixture replacement will offer general features, capacity and efficiency.
- The Plans reserve the right to determine whether covered fixtures will be repaired or replaced. This decision is to be based on availability of replacement components as well as the authorized service provider assessment of the overall condition of the fixture.
- The Plans will not be responsible for matching specific dimensions, color, brands, or any premium fixtures defined as “Upgrades” (see below) of any covered replacement.
Noncovered Items
Noncovered items include, but are not limited to: any pre-existing conditions, circuits not complying with the National Electric Code, components outside the home or attached garage, home networking, voice, data and video cabling, control systems or components, buried wires, overhead lines, permits, unoccupied/vacant homes and low-voltage wiring and equipment. In addition, noncovered items shall also specifically include (and therefore are NOT covered by the Service) any power-generating or power-consuming devices or equipment, including but not limited to the following: appliances of any kind, lighting, generators or power storage systems and photovoltaic equipment.
Access/Restoration
Covered repairs may require access to electrical systems through walls, cabinetry, ceilings, or floors.
- DTE Gas, or The Plan's authorized service provider are not liable for restoration or the cost of restoration for any wall coverings, floor or floor coverings, drywall, cabinets, counter tops, tiling, grout, paint, wallpaper, or the repair of any cosmetic defects resulting from repair, service, or diagnostic efforts.
- DTE Gas or The Plan's authorized service provider are not liable for the cost of construction, carpentry, or other modifications made necessary as a result of completing a diagnostic, a covered repair, fixture replacement, or damage to the customer’s property from such actions.
Termination and/or Transfer of Service
Termination by you
You may cancel this Service by contacting us within 20 days of your original Service order and receive a full refund or credit to your account for fees paid. After the initial one-month term, you may cancel at any time by contacting us. Cancellation of Electric Line Protection will be effective the date we receive your notification.
Termination by us
We reserve the right to discontinue the Service or modify the terms and conditions for the Service at any time for any reason upon written notice to you. Nonpayment by you for the Service will result in immediate termination of the Service by us.
Automatic enrollment
If you set up electric service at a new residence within our service territory, you need to contact DTE Energy to transfer the plan to your new service address. If you do not wish to have the Service at your new property, you may cancel at any time by writing or calling us. If you move, this program does not automatically transfer to the new owners of your residence.
Service Requests
You must contact us directly for all Covered Service requests. When you request Service under this Agreement, one of our authorized independent electrical contractors will contact you within two business days (unless you specify otherwise) to arrange Service. The two-business-day response time cannot be guaranteed during or after extreme weather, earthquake, fire, floods or other acts of God. We will NOT pay for any work performed by electrical contractors who are not dispatched by us.
For any Covered Services up to the $500 annual limit, there will be no additional charge to you. We will pay the authorized independent electrical contractor for the Covered Services up to the limit specified under the “Limits of Covered Services” section. If your electrical problem is not covered by the Service, one of our authorized independent electrical contractors can provide you with an estimate of the installation, repair or replacement costs. If you choose to hire the authorized independent electrical contractor to perform the noncovered item repair, you are solely and completely responsible to pay the authorized independent electrical contractor directly for all noncovered items rendered. These noncovered services are not warranted and are not our responsibility.
Billing, Payment and Late Fees
Billing
For DTE Energy utility customers, all charges for the Service will be included on your monthly utility bill. If you are not our utility service customer, all charges for the Service will be made available to you under separate billing arrangements. No Service will be provided unless your Electric Line Protection account balance is current.
Payment
Payment is due by the bill due date. Your first payment for the Service will be confirmation of and constitutes your acceptance of these terms and conditions, including your consent (per the Privacy Law provision as stated in this Agreement) to release your name, address, phone number, account number and any amounts you pay or owe for the Service to our approved independent electrical contractors, in order to provide Service to you. Your failure to make payment by the due date may result in termination of the Service and may require you to pay the fees and amounts described under “Termination and/or Transfer of Service” above.
How we apply your payment
For electric service customers, our regulated payment application process applies past-due payments first to past-due regulated charges (including electric service and natural gas), then to past-due nonregulated charges (including Electric Line Protection). Once those are paid in full, the remaining payment is applied to your current regulated charges and finally to your current non-regulated charges. Therefore, to ensure continuous service and protection, you must pay in full and on time. Please note your electric services may not be terminated for failure to pay non-regulated charges.
DTE Energy offers optional, market-based products and services that are separate from the regulated services provided by DTE Energy. These services are not regulated by the Michigan Public Service Commission. These products and services may be available from other competitive sources.
The Customer authorizes DTE Energy to use any data associated with the Customer Accounts residing in any DTE Energy files, systems or databases for the purpose of offering and providing energy related products or services to the Customer. DTE Energy will provide this data on a nondiscriminatory basis to any other person or entity upon the Customer’s authorization.
Indemnification, Warranty and Limits of Liability
Indemnification
You understand that we are providing you with this Service for which you expressly agree to indemnify and hold us, our parent corporation, together with all of our and our parent corporation’s officers, directors, agents and authorized independent electrical contractors harmless from and against any and all liability for claims, loss, damage to any personal or real property or injury (including emotional) or death to any persons, unless such loss, damage, injury or death is the direct result of our sole negligence.
Warranty for repair or installation services
We warrant that installation and repairs performed by our authorized independent electrical contractor for Covered Services will be free from defects in installation materials and workmanship for 12 months from the date the installation or repair work is completed. In the event that any installation or repair work performed relating to a Covered Service is found to be defective in either installation materials or workmanship within the 12 months from the date of installation or repair, we may, in our sole discretion, repair or replace such defective items. The repair or replacement of such defective items is your sole and exclusive remedy under this warranty, and we expressly disclaim any and all other warranties including any warranties of merchantability or fitness for a particular purpose, whether express or implied.
Warranty for equipment
For all equipment or parts provided by you, you assume sole responsibility for any warranty action, and we make no warranties whatsoever, but hereby assign to you all applicable manufacturers’ warranties, which may vary by manufacturer and are strictly limited per the express terms and conditions as outlined by that manufacturer. Neither we, nor any authorized independent electrical contractor will engage in any discussions or exercise any discretion whatsoever in selecting the appropriate equipment for you. All equipment selection is your sole responsibility and choice. All manufacturer instructions and installation guidelines shall be communicated to us, in writing, prior to our commencement of any Covered Service. We expressly disclaim any and all other warranties including any warranties of merchantability or fitness for a particular purpose, whether express or implied.
Limits of liability
- In the event of any defects in parts, materials or service provided hereunder, DTE Gas’ only responsibility and the customer’s sole remedy shall be that on request of the customer, during the term of this contract, DTE Gas will repair or replace the defective part, material or service in accordance with the provisions of this contract.
- DTE Gas and its authorized service contractors will not be responsible for direct damage, consequential damages, indirect losses or injuries caused by defects in parts, materials or service provided hereunder, delays, failure to service, unavailability of parts or labor, and any condition beyond reasonable control.
- DTE Gas shall not be liable to the customer for failure to perform obligations under this contract due to any acts of God, strikes, lockouts, acts of the public enemy, lightning, fires, storms, floods, explosions, breakage or accident to machinery, the malfunction of any computer systems (hardware or software) or equipment containing embedded systems of DTE Gas or any provider upon which DTE Gas relies, the binding order of any court or governmental authority, or any other cause outside the reasonable control of DTE Gas.
- DTE Gas reserves the right to assign its rights and obligations to another party.
- Home Protection Plus will not be responsible for charges for appliance service or repairs that others provide without our prior knowledge and consent.
- This contract does not cover any labor, materials or parts required as a result of flooding, attempted repairs by persons other than DTE Gas personnel or authorized contractor, abuse, vandalism, electric power outage or surge, water supply failure, accidents, fire, freezing, pet or pest damage, acts of God, tampering or unauthorized alteration or any other abnormal conditions. Installation errors or omissions that result in either equipment failure or performance issues are not covered by this contract. Service will not be performed in areas where asbestos or any other safety or health hazard exists until the hazard has been eliminated by the customer and at the customer’s sole expense. DTE Gas reserves the right to restrict specific makes of equipment from eligibility due to obsolete parts and reserves the right to use other than original manufacturer’s parts.
- The choice of parts to be used is at DTE Gas’ or their authorized service contractor’s sole discretion. Parts purchased by persons other than an authorized service contractor will not be installed without prior approval.
- Customer will be responsible for costs incurred in missed service appointments.
- DTE Gas may cancel this contract at any time, with or without cause.
- This contract constitutes the entire understanding between the parties with respect to the subject matter of this contract and supersedes any prior discussions, negotiations, agreements, writings and understandings.
- DTE GAS HEREBY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PURPOSE.
- If required by law, DTE Gas will provide a broader limited warranty and limitation of liability.
Nonwaiver and Governing Law
Our i) failure to insist on performance of any of the terms and conditions herein; ii) failure to exercise any right or privilege; or iii) waiver of any breach of this Agreement shall not thereafter waive any of our rights or privileges under this Agreement or at law. Any waiver of any specific breach shall be effective only if given expressly by us to you in writing. This Agreement shall be governed by and construed in accordance with the laws of the state of Michigan, as if performed wholly within the state and without giving effect to the principles of conflict of laws.
Privacy Law
Your enrollment in Electric Line Protection means that you are knowingly consenting to and authorizing DTE Energy to release and share your name, address, phone number, account number and amounts you pay or owe for the Service with our approved independent electrical contractors, in order to provide Service to you.

Electric Line Protection Service is not regulated or sanctioned by the Michigan Public Service Commission. Customers who purchase Electric Line Protection Service will not receive preferential or special treatment from their utility company, and customers are not required to buy it in order to receive safe, reliable electric service.
Furnace Replacement Program Terms & Conditions

The Home Protection Plus Furnace Replacement Program (“Program”) covers the repair or replacement of a standard gas forced air furnace due to normal wear and tear. Coverage is available for single-family residential dwellings, condominiums or mobile homes (“Home”). This Program is part of the DTE Home Protection Plus, and these Terms and Conditions are to be read in addition to and alongside the Home Protection Plus Terms and Conditions. Participants must subscribe to a Home Protection Plus with furnace coverage to be eligible for this Program. All Home Protection Plus Terms and Conditions apply to this Program, including the ‘Limitation of Liability and Exclusion of Warranties’ section.
All equipment covered by this contract must meet all applicable code requirements, be reasonably clean and safely accessible, and be in good operating condition at the time coverage begins. All appliances must have the model and serial tags to be eligible for service, replacement, or any other Program benefits.
- Property enrolled in Home Protection Plus must be located within the DTE utility service area and must have an active DTE utility service agreement in order to participate in the Program.
- The Program is offered through DTE Gas, One Energy Plaza Drive, Detroit, MI 48226 (“DTE”)
- Coverage under the Program begins 90 days after enrollment in the Program. Coverage continues thereafter so long as the customer makes timely payments. Monthly coverage payments must be made in advance. The listed monthly Program charge is for furnace. Additional furnaces may be covered under the Program for an additional per furnace fee equal to the monthly Program price. Coverage is suspended in cases of nonpayment. The customer’s account must be current and in good standing to receive repair and replacement services under the Program
- The Program covers only the repair or replacement of natural gas furnaces by DTE. The Program does not cover: (i) heat pumps, (ii) electric furnaces, (iii) boilers: hot water and steam, (iv) installation of chimney liners, (v) removal of asbestos, or (vi) the correction of ductwork and venting. Coverage for the Program is limited to the repair or replacement of Standard Units. "Standard Units" defined as natural gas forced air furnaces. There are additional costs and fees associated with customer requested changes in efficiency or upgrading to a two-stage.
- The following are excluded from coverage under the Program: (a) pre-existing furnace problems; (b) damage to furnaces caused by the willful or negligent action of the customer or a third party, or by other insurable-type cause; (c) damage due to an “Act of God” ie; flooding, water damage; (d) removal of obstacles including, but not limited to, walls, crawl space doors, attic doors, heating and air ducts, piping, rotted floors, etc. (customer will be solely responsible for removal in order for the technician to provide service); (e) heat pumps and boilers f) any improvements/upgrades/changes required to meet applicable local code; (g) furnaces that have been modified; (h) furnaces that are not up to code; (i) furnaces that are not safely accessible; and (j) furnaces that DTE decides, in its sole discretion, are not covered for any other reason.
- Coverage under the Program will remain in effect until terminated by either DTE or the customer if a claim has not been filed, or upon non-payment by customer, termination of customer's participation in the underlying Home Protection Plus program, or failure by customer to comply with these Terms and Conditions and the Home Protection Plus Terms and Conditions.
- The DTE Program Administrator shall have the right to modify the Program from time to time and will provide thirty (30) days’ written notice of material changes. The Program Administrator shall also have the right to terminate the Program on thirty (30) days’ written notice. The Program Administrator shall have the right to terminate customer’s ability to participate in the Program at any time.
- DTE reserves the right to contract Program work to designated contractors.
- The customer must designate which furnace(s) is covered by the Program when multiple furnaces are present at the time of enrollment. If the customer does not designate the covered furnace, the default furnace shall be deemed to be the furnace serving the main/first floor of the dwelling, or whichever furnace DTE determines to designate as the covered furnace, in DTE’s sole discretion.
- By enrolling in the Program, the customer represents that, to the best of his/her knowledge, the furnace system is free from any pre-existing problems or malfunctions. This includes problems or malfunctions that a reasonable customer would have known about.
- In DTE’s sole and exclusive discretion, DTE’s Program Administrator reserves the right to determine whether repair or replacement is warranted, when service will be provided, what service is necessary and what service will be provided, what furnace is to be installed, and what furnace size is to be utilized. The DTE Program Administrator also reserves the sole and exclusive right to determine coverage eligibility and/or to inspect the furnace to determine coverage eligibility within sixty (60) days from the date of enrollment
- DTE personnel or DTE’s designated contractors must have safe access to the furnace and safe working conditions at and around the work area. DTE disclaims responsibility for work done by anyone other than a DTE-approved contractor. In order to be eligible for coverage for a claim under the Program, the customer is required to notify the Program Administrator of the claim condition before any remedial work is attempted on the furnace, either by the customer or any third party.
- The Program and DTE’s liability is limited solely to the repair or replacement of the covered furnace. The Program and DTE shall have no liability for any direct, indirect, special, incidental, consequential or other damages. The Program will not be responsible for damage caused by the customer, third parties, natural disasters or other insurable causes. In no event will DTE's liability hereunder exceed the greater of the reasonable cost of replacing the covered furnace, as determined by DTE in DTE's discretion, and $5,000 per year.
- Coverage (repair and/or replacement) is limited to a total of $5,000 per year.
- Customer charges for the Program will appear on the customer’s monthly DTE utility bill.
- DTE will not reimburse the customer for work performed by the customer or by a third party. Any such work may invalidate customer's coverage under the Program, as determined by DTE.
- When the customer files any claim under the Program, coverage under the Program will automatically be extended for a period of 18 months from the date of such claim. Notwithstanding anything to the contrary herein, the customer will not be permitted to terminate coverage under the Program during such period.
- If a customer moves before 18 months after a claim is filed, the customer remains responsible for the remaining payments required by the Program.
